Terms of Service

Please read these Terms carefully before using the Chauffit platform. By accessing or booking through Chauffit, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree, do not use the platform.

1. About Chauffit — Platform Nature

Chauffit is a technology-enabled marketplace platform that facilitates on-demand driver services. Chauffit connects customers who need a professional driver for their own private vehicle with independent driver partners registered on the platform.

Chauffit is not a transport service provider. Chauffit:

  • Does not own, lease, or operate any vehicles.
  • Does not provide passenger transport services.
  • Does not employ drivers. Driver partners are independent contractors.
  • Acts solely as an intermediary, facilitating connections, payments, and safety infrastructure between customers and driver partners.

Chauffit is classified as an E-commerce Operator (ECO) and a marketplace for driver services. It is not a transport aggregator under Section 9(5) of the CGST Act, 2017, and is not a fleet operator.

The service facilitated is: "On-demand engagement of independent drivers who operate the customer's own vehicle." This constitutes a driver service or manpower support, not a passenger transport service.

2. Eligibility and Account

2.1 Eligibility

To use Chauffit, you must:

  • Be at least 18 years of age.
  • Be the registered owner or authorised user of the vehicle for which you are booking a driver.
  • Have a valid mobile number and email address.
  • Comply with all applicable laws in India.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify Chauffit immediately at chauffit@gmail.com if you suspect any unauthorised use of your account.

2.3 Account Termination

Chauffit reserves the right to suspend or terminate your account at its discretion if you violate these Terms, misuse the platform, or engage in fraudulent, abusive, or illegal conduct.

3. The Booking Process

3.1 Requesting a Ride

You may request a driver through the Chauffit app by selecting your ride type (one-way, multi-stop, round trip, or hourly), entering your pickup location, and confirming the estimated fare. A booking is confirmed only when a driver partner accepts your request.

3.2 Driver Assignment

Chauffit's matching engine identifies available driver partners near your pickup location. Driver partners retain the right to accept or reject any booking at their sole discretion. Chauffit does not guarantee that a driver will be available at any given time or location.

3.3 Driver Arrival

Once a driver is assigned, their verified profile, photo, and live location will be visible in the app. You will hand over your vehicle keys in person upon the driver's arrival at your specified pickup point.

3.4 Completion

The ride is considered complete upon reaching the agreed destination or at the end of the agreed hourly period. The final fare is calculated based on the actual distance, time, and applicable charges, and will be charged to your registered payment method.

4. Pricing, Fares, and GST

4.1 Fare Components

All fares are calculated using the following formula:

Total Fare = Base Fare + (Per km rate × Distance) + (Per minute rate × Time) + ₹19 Booking Fee + Applicable GST

4.2 Ride Types

  • One-Way / Multi-Stop: Base fare ₹99. Minimum total fare ₹249 (excluding GST).
  • Hourly Booking: Packages start at ₹399 for 2 hours. 4, 6, and 8-hour packages available in-app.
  • Round Trip: Priced on hourly package rates.

4.3 GST Treatment

Chauffit operates as an E-commerce Operator (ECO) and is not classified as a transport aggregator under Section 9(5) of the CGST Act, 2017. Accordingly:

  • GST at 18% is levied on Chauffit's platform commission/service fee only. Not on the total ride fare.
  • Driver partners who are unregistered individuals are not required to charge GST on their service component.
  • You will be shown the complete estimated fare. Including all applicable charges. Before confirming any booking.

4.4 Displayed Prices

All prices displayed on this website and in the app are exclusive of GST unless explicitly stated otherwise. The final fare including all charges will be presented in-app before booking confirmation. There are no hidden charges.

4.5 Surge and Dynamic Pricing

Chauffit may apply demand-based pricing during peak periods. Any applicable surge will be disclosed to you before booking confirmation.

5. Payment Terms

5.1 Payment Collection

Chauffit collects the total fare from you on behalf of the driver partner and itself. Chauffit acts as a collection agent and settlement intermediary. Payment is collected via the app at the time of booking or at ride completion, depending on the payment method selected.

5.2 Payment Methods

Chauffit supports UPI, credit/debit cards, and other digital payment methods available in-app. Cash payments are not supported through the platform.

5.3 Failed Payments

If a payment fails or is disputed, Chauffit reserves the right to suspend your account until the outstanding amount is resolved.

5.4 Invoicing

An electronic receipt will be issued after each completed booking to your registered email address.

6. Cancellations and Refunds

6.1 Customer Cancellations

You may cancel a booking before driver arrival. Cancellation charges may apply depending on the time elapsed since booking confirmation. The applicable cancellation policy will be displayed in-app at the time of cancellation.

6.2 Driver Cancellations

If a driver partner cancels an accepted booking, you will not be charged. Chauffit will attempt to reassign another driver partner.

6.3 No-Show

If you are not present at the agreed pickup location within a reasonable waiting period after the driver's arrival, the booking may be cancelled and a no-show fee may apply.

6.4 Refunds

Approved refunds will be credited to your original payment method within 5–7 business days. Refund eligibility is determined at Chauffit's sole discretion based on the circumstances of each case.

7. Your Vehicle and Responsibilities

7.1 Vehicle Condition

You confirm that the vehicle for which you are booking a driver is:

  • Registered in your name or that you have lawful authority to authorise its use.
  • Roadworthy, insured, and compliant with all applicable traffic laws and RTO regulations.
  • Fitted with valid PUC (Pollution Under Control) certification.

7.2 Insurance

You are responsible for maintaining adequate insurance on your vehicle. Chauffit does not provide vehicle insurance. Any claims arising from an incident during a Chauffit booking must be made under your own vehicle insurance policy.

7.3 Traffic Violations

Any traffic violations, challans, tolls, or parking charges incurred during a ride are the responsibility of the vehicle owner. Chauffit is not liable for any such charges.

7.4 Personal Belongings

Chauffit is not responsible for any loss or damage to personal belongings left in the vehicle before, during, or after a booking.

8. Driver Partners — Independent Contractors

All driver partners on the Chauffit platform are independent contractors. They are not employees, agents, or representatives of Chauffit. Specifically:

  • Drivers set their own availability and retain the freedom to accept or decline any booking.
  • Chauffit does not control the manner in which drivers perform their services, beyond quality and safety standards required for platform participation.
  • Chauffit's certification of a driver ("Chauffit-Certified Driver Partner") reflects quality standards only and does not establish an employment relationship.

Chauffit conducts background verification and licence checks (via VAHAN portal) for all driver partners before they are permitted to accept bookings. However, Chauffit cannot guarantee the conduct of any individual driver partner and shall not be liable for the acts or omissions of driver partners beyond what is set out in Section 10.

9. Safety and Conduct

9.1 Customer Conduct

You agree to:

  • Treat driver partners with respect and dignity at all times.
  • Not ask driver partners to violate traffic rules, speed limits, or any applicable law.
  • Not use the platform for any illegal or unauthorised purpose.
  • Not carry prohibited items in the vehicle during a Chauffit booking.

9.2 Reporting

Any incidents, misconduct, or safety concerns must be reported through the Chauffit app or by contacting Chauffit at chauffit@gmail.com immediately after the ride.

9.3 Emergencies

In any emergency situation, contact local emergency services (Police: 100, Ambulance: 108) immediately. Chauffit's platform is not a substitute for emergency response services.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Chauffit's total liability to you for any claim arising from your use of the platform shall not exceed the fare paid by you for the specific ride giving rise to the claim.
  • Chauffit shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Chauffit is not liable for any loss or damage arising from the acts or omissions of driver partners, traffic conditions, vehicle condition, or force majeure events.
  • Chauffit provides the platform on an "as-is" and "as-available" basis without warranties of any kind.

Nothing in these Terms excludes or limits liability which cannot be lawfully excluded or limited under applicable Indian law.

11. Intellectual Property

All intellectual property on the Chauffit platform. Including the name "Chauffit", the logo, wordmark, app design, technology, and content. Is owned by or licensed to Chauffit. You may not use, reproduce, or distribute any Chauffit intellectual property without prior written consent.

12. Data and Privacy

Your use of the Chauffit platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable IT laws. By using Chauffit, you consent to the data practices described in the Privacy Policy.

13. Amendments

Chauffit reserves the right to amend these Terms at any time. Material changes will be notified to you via the app or your registered email address. Continued use of the platform after notification of changes constitutes your acceptance of the updated Terms. The date of the most recent update is shown at the top of this page.

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India.

14.2 Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms, the parties shall first attempt to resolve the matter amicably through good-faith negotiations. If the dispute is not resolved within 30 days, either party may refer the matter to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be Gurugram, Haryana.

14.3 Jurisdiction

Subject to the arbitration clause above, the courts in Gurugram, Haryana shall have exclusive jurisdiction over any dispute arising under these Terms.
